Master terms governing access to and use of the Winstory platform.
Master Terms — Winstory
ARTICLE 1 — PURPOSE
These Master Terms govern access to Winstory, the account, Campaigns, Contributions, AI Studio, payments, the Wallet, moderation and Rewards. They bind the person who accepts them for the relevant use. A special module prevails over these terms only for its own subject, without setting aside a mandatory rule. Payment obligations already incurred, confidentiality, licences for their agreed term, evidence and legally required retention survive account closure.
ARTICLE 2 — PUBLISHER
The platform is operated by WINSTORY, a French simplified joint-stock company, SIREN 924 927 965. The correspondence address stated for these terms is 8 rue de Wattignies, 75012 Paris, France. The president is Vincent Roux. Share capital, the RCS registry and the VAT number appear on invoices when they are required. Full identity is set out in the legal notice.
ARTICLE 3 — HIERARCHY
Unless a mandatory rule provides otherwise, the order is: applicable law, information specific to the transaction, the Campaign Terms, the role module (individual, professional or agency), the UGC Terms, the AI Studio Terms, the Payment Terms, then these Master Terms. If two texts conflict on the same subject, the more specific text prevails. No module may set aside consumer rights that cannot be waived.
ARTICLE 4 — DEFINITIONS
Campaign: a video operation governed by its parameters. Creator: a user who configures it. Completer: a user who submits a Completion. Moderator: a user who assesses under the moderation rules. Contribution: submitted content. Funded: the payment has entered the Campaign economy. Validated: the Contribution meets the criteria and may become eligible for a Reward. Ranked: a validated Contribution receives a deterministic rank used, where applicable, to allocate the Reward. Reward: a benefit provided by the Campaign, which may be zero. Wallet: a display space for credits or entitlements, whose withdrawal depends on the applicable module. Funded is not Validated. Validated is not a guaranteed Reward. Payment is not a guaranteed return.
ARTICLE 5 — ACCOUNT AND CAPACITY
The user provides accurate information and protects access credentials. Account sharing and unauthorised automation are prohibited. Public browsing of the site is not restricted by this article. Paid flows, Rewards, payouts, the Moderator’s USDC deposit and AI Studio when it uses a person’s image or voice are reserved to persons aged at least eighteen. Winstory may request proof of identity before a payout. A false declaration allows proportionate suspension and preservation of evidence.
ARTICLE 6 — ACCOUNT SECURITY
The user is responsible for acts carried out with the user’s credentials or connected wallet, except use after the user has promptly reported a compromise. The user reports abnormal use. Winstory may lock access where there is a serious indication of fraud or attack, for the time needed to verify. A lock does not forfeit a sum already earned without a legal ground. Access logs are evidence, which a consumer may challenge.
ARTICLE 7 — CAMPAIGNS
Each Campaign has its parameters, price, duration, brief and economic rules, displayed before paid participation. The user reads them. Winstory does not retroactively change an essential element of a Campaign already paid for, except to correct an obvious error, to meet a legal requirement or to take a proportionate security measure. The Campaign Terms supplement this article.
ARTICLE 8 — PARTICIPATION
Taking part guarantees neither validation, nor a rank, nor a positive Reward. An individual’s participation price and the AI Studio cost are separate amounts. Creative rejection of a Contribution is not, by itself, the standard refund of the price. Refund rules are set out in the Individual Terms and the Payment Terms.
ARTICLE 9 — TWO KINDS OF MODERATION
Platform moderation addresses unlawful content, infringement, fraud and security. Campaign moderation addresses the brief, completeness and creative criteria. Rejection under one does not automatically carry the effects of the other. Remedies and financial consequences follow the ground actually relied on.
ARTICLE 10 — ALLOCATION OF REWARDS
For the settlement mechanics concerned, monetary eligibility and allocation do not result from a draw, a lottery, a roulette, a jackpot or a loot box. Rank is deterministic. A random financial tie-break is not used. This clause describes the product. It is not an approval by a gambling authority.
ARTICLE 11 — AI STUDIO
AI Studio lets a user request video generation from third-party providers. Models may change or be unavailable. The result may not be unique. The user warrants rights in prompts and reference media. The AI Studio cost is distinct from the Campaign price and from the Reward. The AI Studio Terms apply.
ARTICLE 12 — PAYMENTS
Card payments and cash Reward payouts run through Stripe, including Stripe Connect for the canonical payout. Winstory is not a payment institution. A provider failure, rejection or hold may delay a payout without extinguishing a right already accrued, subject to fraud. The Payment Terms detail each economic object.
ARTICLE 13 — WALLET
Credit from a top-up, promotional credit, the participation price, an AI Studio debit, a Reward and the Moderator’s USDC deposit are not interchangeable. Spendable credit usable at Winstory is not presented as freely withdrawable money. Promotional credit is not convertible into cash. Detail is in the Payment Terms.
ARTICLE 14 — PROVIDERS
Winstory depends on Stripe, AI providers, the host, the database and, for some functions, a public chain and the user’s wallet software. Winstory does not guarantee the permanent availability of those third parties. That dependence does not set aside Winstory’s own legal duties, including conformity of a digital service where it applies to a consumer.
ARTICLE 15 — INTELLECTUAL PROPERTY
The user keeps title to the user’s content. Upload does not transfer ownership to Winstory. A technical licence is needed to host, display and moderate. A Campaign licence covers the exploitation provided for that Campaign. Any wider commercial exploitation, voice cloning, synthetic identity and model training require a separate authorisation. The UGC Terms state the scope.
ARTICLE 16 — ACCEPTABLE USE
It is prohibited to submit unlawful content, infringing content, content that invades privacy or image rights, to impersonate, to distribute malware, to manipulate a vote, a rank or moderation, to create abusive multiple accounts, to collude or to use a third party’s trade mark without right. The moderation policy details the categories. The sanction is proportionate to the breach and to whether it is repeated.
ARTICLE 17 — FRAUD AND CHARGEBACK
Payment fraud, an abusive chargeback, use of a payment method without right and a false statement of authority allow Winstory to suspend the flows concerned, to keep evidence and to claim direct loss. A Reward obtained by fraud is not owed. A sum legitimately earned by a good-faith third party is not forfeited because of someone else’s fraud. The consumer keeps statutory remedies.
ARTICLE 18 — SUSPENSION
Winstory may suspend an account, a Campaign or content in the event of fraud, attack, unlawful content, payment abuse, rank manipulation or a requirement of an authority. The measure states its ground to the extent that can be disclosed without compromising an investigation. It is lifted when the ground has ceased. It does not cancel a monetary claim already accrued, except fraud by its holder or a legal duty to block.
ARTICLE 19 — TERMINATION
The user may stop using the service and request account closure, subject to operations in progress and retention periods. Winstory may terminate for a serious breach not remedied after notice where notice is compatible with urgency. After the end, accrued payment, licences for their term, confidentiality, claims already arisen and retention required by law survive.
ARTICLE 20 — AVAILABILITY
The service is provided according to the state of the platform. Winstory does not promise uninterrupted availability or the continued availability of a given AI model. Planned interruption is notified where reasonably possible. Unavailability attributable to Winstory opens, for the consumer, the digital-service conformity remedies where they apply. It is not, by itself, force majeure.
ARTICLE 21 — FORCE MAJEURE
Force majeure is an event that is external, unforeseeable and irresistible within the meaning of the Civil Code. An ordinary provider outage, a foreseeable capacity shortfall or an internal defect that Winstory could have prevented is not labelled force majeure. During a qualifying event, the obligations that are prevented are suspended. Sums already due remain due. The consumer keeps the right to terminate if the prevention lasts beyond what is acceptable for the service.
ARTICLE 22 — LIABILITY
Winstory is liable for its essential obligations and for foreseeable direct loss. Between professionals, liability is limited to the fees paid for the Campaign concerned, with no separate numeric cap. Fraud, wilful misconduct, bodily injury and any liability that the law forbids to limit are reserved. No clause sets aside the consumer’s mandatory remedies, including conformity of digital content or of a digital service.
ARTICLE 23 — EVIDENCE
The following may serve as evidence, according to their reliability: account records, the snapshot of Campaign parameters, payment records, timestamps, moderation logs, electronic exchanges and, where an operation is recorded on a public chain, the transaction identifier. These elements are not irrebuttable against a consumer. Electronic writing is admissible under the conditions of the Civil Code.
ARTICLE 24 — DATA
Processing of personal data is described in the privacy policy. Acceptance of these terms is not a global consent to all processing and is not consent to trackers. Where a professional customer determines the purposes of processing, the DPA applies to the part where Winstory acts on the customer’s behalf. Winstory remains controller for its own purposes, including billing, security and proof of acceptance.
ARTICLE 25 — VERSION AND LAW
The version that applies is the one accepted for the operation concerned, where acceptance is recorded, or otherwise the one published at the time of the operation. French law applies. The consumer keeps the mandatory rules of the State of residence where they apply, and the court that has jurisdiction under those rules. Between professionals, the courts of Paris have jurisdiction, subject to a mandatory jurisdiction rule.
ARTICLE 26 — COMPLAINTS
A complaint is sent in writing to the correspondence address, 8 rue de Wattignies, 75012 Paris, France. Where a contract is concluded with a consumer, the consumer may refer the matter to the consumer mediator to which Winstory has adhered. That mediator’s details are published when adhesion is effective. This clause does not describe an electronic content-reporting form, which belongs to the reporting policy.
ARTICLE 27 — ADULT PARTICIPATION
Creation, contribution, AI Studio, moderation, moderator staking and payment or Reward flows are reserved, under Winstory’s product policy, to persons aged at least 18. Public browsing alone is not subject to this requirement. Winstory does not record date of birth for this attestation.
