AI Studio Terms — Winstory

ARTICLE 1 — PURPOSE

AI Studio lets a user request a video generation. It is distinct from a Campaign, a Completion and a Reward. Its cost is distinct from P.

ARTICLE 2 — ROUTING

Winstory routes the request to a provider in the active catalogue. The provider and the model may change or be unavailable. Winstory does not extend to one provider the contractual terms read for another.

ARTICLE 3 — INPUTS

The user warrants rights in the prompt, the reference images and the reference sounds. The user does not send a person’s data without a legal basis. The user does not send prohibited content.

ARTICLE 4 — REAL PERSONS

Generating or manipulating the image or voice of an identifiable real person requires authorisation. Voice cloning and synthetic identity are not included in an ordinary generation. A result presented as authentic when it is synthetic must be labelled as such where the law or the Campaign requires it.

ARTICLE 5 — OUTPUT

Subject to third-party rights and the provider’s terms, the user may use the output for the purpose paid for. Winstory does not warrant that the output is original, unique or free of rights. Similar outputs may be supplied to other users. The output may not be unique.

ARTICLE 6 — COST

The price displayed before generation is due if generation is started at the user’s request. It does not feed a Campaign reward pool. A free Completion does not include free AI generation. Outputs may not be unique.

ARTICLE 7 — FAILURE

If no output is delivered for a cause attributable to the service, the user has the conformity remedy, which may be a further attempt or a refund of the cost of that generation. A Campaign creative rejection does not, by itself, refund that cost. Dissatisfaction with style, where the output matches the essential request, is not a lack of conformity.

ARTICLE 8 — PROVIDERS

Providers process inputs under their own terms. Winstory does not state that each of them has waived every derived use, or that a processing agreement is signed with each of them, where that is not the case for that provider. The user remains bound not to submit content prohibited by those terms to the extent they are enforceable against the user through the service.

ARTICLE 9 — TRAINING

Winstory does not acquire the right to train its own models on inputs or outputs. A provider may apply its terms to its own systems. That does not authorise Winstory to reuse the content for a separate training.

ARTICLE 10 — TRANSPARENCY

The user is informed that the user is interacting with an AI system. Where a published output could be taken for a real recording of a person, a visible statement is required. Machine-readable marking is not presented as already active on every output.

ARTICLE 11 — PROHIBITED USES

It is prohibited to generate non-consensual sexual content, content harming minors, fraudulent impersonation, terrorist content or a security bypass. Winstory may refuse or delete such a request and keep the evidence.

ARTICLE 12 — RETENTION

Inputs and outputs are kept for the time of the service, of billing evidence and of legal duties, then deleted or anonymised. A provider’s exact periods depend on that provider and are not presented as identical for all.

ARTICLE 13 — DATA

The prompt may contain personal data. The basis for processing by Winstory is performance of the service requested and, for security, legitimate interest. Detail is in the privacy policy.

ARTICLE 14 — WITHDRAWAL

For the consumer, generation is a digital service that may start immediately only on an express request. Loss of the right of withdrawal is not presented as having occurred until the consents required by law are collected for that operation.

ARTICLE 15 — LIABILITY

Winstory is liable for delivery of the service under the conformity conditions. It is not liable for the provider’s creative choice where the output matches the essential request. Between professionals, the cap of the fees of the operation concerned applies, with the legal reservations.

ARTICLE 16 — SECURITY

The user does not attempt to extract a model, bypass a filter or probe the systems. Winstory may stop an abusive request.

ARTICLE 17 — EVIDENCE

The generation identifier, the price and the timestamp are evidence of the request, without being irrebuttable against a consumer.

ARTICLE 18 — SURVIVAL

The price due, the licence to use the output for the purpose paid for, the prohibition on training by Winstory and evidence survive the end of the account.

ARTICLE 19 — MINORS

AI Studio, where it concerns image or voice, is reserved to persons aged at least eighteen. A request aimed at a minor in an unlawful way is refused.

ARTICLE 20 — LAW

French law applies, without depriving the consumer of the mandatory rules of the consumer’s residence. The provider’s terms may add use limits that the user must respect.
