Video Contribution Rights — Winstory

ARTICLE 1 — TITLE

The author retains intellectual property in the Contribution. Upload does not transfer ownership to Winstory, the agency or the sponsor.

ARTICLE 2 — TECHNICAL LICENCE

The author grants a non-exclusive technical licence, worldwide for the servers used, free of charge, for the hosting period required: to reproduce, store, convert format, display and transmit in order to operate, secure and moderate the platform. This licence does not cover paid advertising.

ARTICLE 3 — CAMPAIGN LICENCE

For the Campaign to which the Contribution is submitted, the author grants the reproduction and communication needed for that Campaign, on the media and for the term displayed. The territory is the one displayed, otherwise the countries where the Campaign is offered. This licence does not include adaptation beyond indispensable technical cropping, unless a separate option is selected.

ARTICLE 4 — OPTIONAL COMMERCIAL LICENCE

Paid advertising, e-commerce, television, cinema, outdoor digital display, point of sale, events, press relations and international channels are covered only if the author authorises them separately, with territory, term and media stated. Mere participation does not grant them.

ARTICLE 5 — ADAPTATION

Subtitling, dubbing, localisation, still-image extraction, thumbnails and compilation are allowed under the Campaign licence only to the extent necessary to display that Campaign. Any other adaptation is a separate option. The author’s moral right, in particular attribution and integrity, is not assigned.

ARTICLE 6 — TERM AND TERRITORY

If no term is displayed, the Campaign licence lasts for the Campaign plus twelve months for that Campaign’s archives. It is not perpetual. An unspecified territory is not worldwide for optional commercial exploitation.

ARTICLE 7 — IMAGE AND PERSONS

The author warrants the authorisation of identifiable persons, for the intended use. Upload alone does not mean Winstory holds a file of releases. If a person objects with a credible element, Winstory may remove the Contribution. The sponsor remains bound by its own image authorisations.

ARTICLE 8 — VOICE

Recording a voice for a Contribution does not authorise voice cloning, synthesis of an identity or impersonation. Those uses require separate express consent. The same applies to a synthetic image of a real person.

ARTICLE 9 — MUSIC

The author warrants the rights in the composition, the lyrics, the recording and the performances, including synchronisation if the Campaign involves it. Unauthorised commercial music may be removed. A library supplied by the platform may be used only within the limits stated with it. Music generated by AI remains subject to third-party rights it might reproduce.

ARTICLE 10 — PERFORMERS

Authorisation to fix and communicate a performer’s performance is distinct from copyright. The author of the Contribution warrants that authorisation for the intended use. The performer’s moral right is not set aside.

ARTICLE 11 — MINORS

A minor appearing in a Contribution requires the representative’s authorisation. Otherwise the content is removed as soon as Winstory is credibly informed.

ARTICLE 12 — TRAINING

No right is granted to Winstory to train or fine-tune a model on the Contribution, the face, the voice or the prompt. Such use requires separate explicit consent. Acceptance of these terms does not give it.

ARTICLE 13 — TRADE MARKS IN CONTENT

The author does not insert a third-party trade mark without right. The sponsor does not extend its trade mark beyond the Campaign licence.

ARTICLE 14 — REMOVAL

Winstory may remove a Contribution for infringement, image, privacy or prohibited content. Platform removal is distinct from Campaign rejection. It does not automatically cancel a Reward already settled, except for a legal duty or fraud.

ARTICLE 15 — PROPORTIONATE WARRANTY

The author does not knowingly submit an infringement. Against a consumer, the consequence is removal and compensation for direct loss within the legal limit, without an unlimited indemnity. Between professionals, the indemnity in the professional terms may apply.

ARTICLE 16 — EVIDENCE OF RIGHTS

Winstory may request evidence of authorisations. Failure to provide it allows removal. The request does not mean a release is currently held.

ARTICLE 17 — NETWORKS

Organic distribution on the Campaign’s accounts is included in the Campaign licence if it is displayed. Paid distribution is an option under article 4.

ARTICLE 18 — END OF THE LICENCE

At the end of the term, the sponsor stops new uses. Copies already lawfully distributed are not recalled except for a legal duty or a contrary term displayed. Evidence archives are kept.

ARTICLE 19 — SURVIVAL

The technical licence survives for the hosting period and legal duties. The Campaign licence survives for its own term. The warranty in article 15 survives for infringements arising during use.

ARTICLE 20 — AI TRANSPARENCY

If the Contribution is generated or manipulated by an AI system so that a person might believe it real, the author does not hide that nature where the Campaign or the law requires a statement. Machine-readable marking, when it is available on the platform, may be added. Its absence today does not remove a required visible statement.

ARTICLE 21 — MANDATORY LAW

Nothing sets aside moral rights or an authorisation required by law. A clause wider than an option actually selected is reduced to that option.

ARTICLE 22 — ORDER

In the event of conflict, the authorisation option prevails over a general formula. The Master Terms yield to this module for rights in Contributions.

ARTICLE 23 — MATRIX

The technical operating licence, the Campaign participation licence and optional commercial rights are distinct. Voice cloning, synthetic likeness use and training of AI models are not included by default. They require an express choice. Territory, term, beneficiary and permitted modifications are those of the rights profile accepted for the version concerned. Earlier content without verifiable acceptance is not deemed authorised for new commercial exploitation.
