Individual and Consumer Terms — Winstory

ARTICLE 1 — SCOPE

These terms supplement the Master Terms for the Individual Creator and the Completer who is not acting for the purposes of a trade. A professional is governed by the professional terms. If status is doubtful, the person is treated as a consumer if the person is not acting for a business.

ARTICLE 2 — PRE-CONTRACT INFORMATION

Before being bound, the consumer receives, on the relevant flow, Winstory’s identity, the main characteristics, the price inclusive of tax or how it is calculated, the duration, and whether a right of withdrawal exists. Durable-medium confirmation follows the order where the law requires it. The absence of a stored acceptance for an older operation does not invent information that the flow did not display.

ARTICLE 3 — CREATOR PRICE

The Individual Creator’s payment is the price of configuring the Creator’s Campaign. It is distinct from the AI Studio cost, Wallet credit and a Reward. It does not buy a rank or a random gain. The price displayed at the time of the order is the price due, subject to an obvious error reported before performance.

ARTICLE 4 — COMPLETION PRICE

The price P of a paid Completion is the price of participation in that Campaign. Funded means that this payment has entered the Campaign economy. Funded does not produce the state Validated. The payment is not a bet.

ARTICLE 5 — VALIDATED AND RANKED

A Contribution is Validated when it meets the displayed criteria. It is then eligible for a Reward, without eligibility promising a positive amount. It is Ranked when the deterministic ranking assigns it a rank. Ranked is used for allocation. It does not result from a draw.

ARTICLE 6 — ACTIVATION THRESHOLD

An individual Campaign is not economically activated until five (5) Funded Completions required by the displayed rule are reached. Before that threshold, the Campaign does not enter the Reward settlement provided for an activated Campaign. This threshold of five (5) is not imposed on a professional Campaign, which follows its own parameters.

ARTICLE 7 — NON-ACTIVATION

If the individual Campaign is not economically activated by the displayed deadline, the Funded participation price is handled under the non-activation refund rule, and not as a Reward. AI Studio already performed at the user’s request is not refunded merely because the Campaign is not activated, subject to the conformity remedy if the generation itself is defective.

ARTICLE 8 — CREATIVE REJECTION

Rejection of a Contribution for failure to meet the brief or a creative criterion does not open the standard refund of the price P. It is distinct from removal for unlawful content and from a technical lack of conformity. The user may submit a new Contribution if the Campaign still allows it.

ARTICLE 9 — AI STUDIO AND A FREE COMPLETION

A Completion without a price P does not include an AI Studio generation. The AI Studio cost is debited under the AI Studio Terms, separately from P. A generation failure is not a moderation rejection. The detail of the debit and of a repeat is set out in those AI Studio terms.

ARTICLE 10 — CONFORMITY

Where Winstory supplies a digital service or digital content to the consumer, that service or content must conform. Lack of conformity includes, in particular, inability to access the paid service, a generation that is not delivered, or operation that departs from the essential description. The following are not, by themselves, a lack of conformity: creative rejection, subjective dissatisfaction with style, the absence of a Reward, or the selection of another participant who ranks higher. Statutory remedies, bringing into conformity and then price reduction or termination in the cases provided, are not waived.

ARTICLE 11 — WITHDRAWAL — FRAMEWORK

The consumer in principle has fourteen days to withdraw from a distance contract, running from the day of conclusion for a service, and from the day of receipt for digital content supplied on a medium. The period and the form follow the Consumer Code. Winstory refunds the sums due by the same means, unless another means is agreed, within the statutory period.

ARTICLE 12 — IMMEDIATE PERFORMANCE

A service may start before the end of the withdrawal period only if the consumer expressly requests it. For digital content not supplied on a tangible medium, loss of the right of withdrawal requires, where the law so provides, express consent to supply during the period and acknowledgement of losing that right, then confirmation on a durable medium. The click specific to each transaction is not described here as already collected on every flow. Until it is collected, Winstory does not present the right as lost.

ARTICLE 13 — WITHDRAWAL BY OPERATION

The Creator’s payment, the price P, an AI Studio generation and a Wallet top-up are separate operations. The right of withdrawal is assessed for each of them. A free Completion is not a paid contract. Payout of a Reward already earned is not a new purchase. The Moderator’s USDC deposit is governed by the Moderator terms.

ARTICLE 14 — REWARD AND PAYOUT

A monetary Reward is owed only if the states Funded, Validated and Ranked, and the other displayed conditions, are met. It may be zero. The canonical payout runs through Stripe Connect. Winstory may defer the payout for the time of the provider’s checks. The recipient declares the recipient’s taxes. Winstory does not give tax advice and does not invent a withholding.

ARTICLE 15 — INDIVIDUAL FRAUD

Multiple accounts intended to circumvent a threshold, collusion and rank manipulation cause loss of eligibility for the Reward concerned. The price paid may be retained to the extent of the loss and of the law, without a manifestly excessive penalty. Evidence is kept. The consumer may challenge it.

ARTICLE 16 — USER WARRANTIES

The user warrants having the rights in what the user submits, including the image, voice and music of persons who appear. The user does not present as the user’s own a work in which the user has no rights. A breach allows removal and, if it causes a third-party claim, bearing of the direct loss to the extent the law allows against a consumer. No unlimited indemnity is imposed on the consumer.

ARTICLE 17 — MINORS

A person under eighteen does not enter into the paid, Reward, payout or deposit operations described in article 5 of the Master Terms. If content shows a minor, the user warrants the authorisation of the legal representative. Winstory removes the content when it is informed of a lack of authorisation.

ARTICLE 18 — PROOF OF THE ORDER

The summary displayed, the payment record and the timestamp are evidence of the order, without being irrebuttable. The second display of the price before confirmation is the moment at which the consumer can still correct an input error where the flow provides for it.

ARTICLE 19 — TERMINATION BY THE INDIVIDUAL

The individual may stop using the service. Campaigns already Funded follow their rules until their end or their non-activation. Closure does not, by itself, refund a generation already supplied at the consumer’s request after the required consents.

ARTICLE 20 — MANDATORY LAW

Any clause that would create a significant imbalance to the detriment of the consumer, or that would set aside a right of withdrawal, conformity or mediation, is deemed unwritten for that part. A professional who wrongly claims to be a consumer does not benefit from that regime.

ARTICLE 21 — MEDIATION

The consumer may refer the matter to the consumer mediator to which Winstory has adhered, after attempting a written complaint to 8 rue de Wattignies, 75012 Paris, France. The mediator’s details are provided when they exist. That route is free of charge for the consumer.

ARTICLE 22 — SURVIVAL

The following survive the end of the account: the price already due, the non-activation refund if it has arisen, the Reward already earned, licences for their term, evidence and limitation periods. This module does not change the ranking formulas or the threshold of five (5) Funded Completions.
