Content Notices and Rights Complaints — Winstory
ARTICLE 1 — PURPOSE
This policy describes how a notice of unlawful or infringing content must be framed, and how Winstory handles it. It distinguishes that notice from creative rejection for being off-brief.
ARTICLE 2 — WHO MAY GIVE NOTICE
Any person may give notice of content the person considers unlawful. The holder of a right may give notice of an infringement of that right. The notice is made in good faith.
ARTICLE 3 — ELEMENTS
The notice explains why the content is unlawful, states its exact location, the identity and contact of the notifier subject to legal exceptions, and contains a statement of accuracy in good faith. Those elements allow a review. This policy does not present them as already captured in a form on the site.
ARTICLE 4 — LOCATION
The location is the page address or the Campaign and Contribution identifiers sufficient to find the content without a disproportionate search.
ARTICLE 5 — COPYRIGHT
For copyright, the notifier identifies the work and the Contribution in dispute, and states that the notifier is the holder or is authorised. An incomplete request may be completed before a decision.
ARTICLE 6 — TRADE MARK
For a trade mark, the notifier identifies the sign and the challenged use. A descriptive nominative use is not, by itself, an infringement.
ARTICLE 7 — IMAGE AND PRIVACY
For image or privacy, the notifier explains the lack of authorisation and the harm. Winstory may remove in the meantime if the harm is credible.
ARTICLE 8 — NON-CONSENSUAL INTIMATE CONTENT
Non-consensual intimate sexual content is removed as a priority when it is identified. The notice may omit some identity elements where the law protects the notifier.
ARTICLE 9 — HANDLING
Winstory acknowledges receipt where a receiving channel is used, reviews the elements and decides to keep, remove or limit. Urgency allows a provisional measure.
ARTICLE 10 — PERSON AFFECTED
The person who published, where known and where the law allows it, is informed of the ground, the essential facts and the route to respond. Information may be deferred if it would compromise an investigation or the protection of a victim.
ARTICLE 11 — REDRESS
The person affected by a platform restriction may request a review. That review is distinct from a challenge to an off-brief rejection, which remains a Campaign route.
ARTICLE 12 — ABUSE OF NOTICES
Repeated bad-faith notices may be disregarded. They do not defeat a later serious notice.
ARTICLE 13 — EVIDENCE
The notice, the decision and the timestamp are kept for the time of redress and limitation. They are not irrebuttable.
ARTICLE 14 — AUTHORITIES
Winstory cooperates with an authority that sends it a lawful request. That cooperation does not replace a private person’s notice.
ARTICLE 15 — FINANCIAL EFFECTS
Removal for unlawfulness does not automatically cancel a Reward already settled to a good-faith third party. Fraud by the author does cause loss of that author’s eligibility.
