These Terms and Conditions are subject to French law. Winstory reserves the right to modify this jurisdiction based on regulatory changes and geographical relocations of its headquarters.
These Terms and Conditions are regularly updated. The effective version is indicated at the top of the document.
Before using the platform, the user must carefully read and understand these terms and conditions. These conditions constitute a legal contract between the user and Winstory, hereinafter referred to as "Winstory," "we," or "our."
By accessing the website, creating a user account, or using the platform or services:
- The user confirms having read and understood these conditions;
- And accepts these conditions in their entirety.
The Winstory platform serves as a marketplace dedicated to the creation, co-creation, and management of textual and visual content, in the form of interactive campaigns based on decentralized and collaborative narrative content. Winstory's services include staking and community-based moderation mechanisms for our immersive token in our ecosystem, subject to the conditions described below. The Winstory platform also offers a reward system initiated by Companies in their Campaigns, valuing community contributions, including standard and premium rewards, adapted to engagement and the quality of collaborative contributions.
We reserve the right to modify these conditions at any time and without notice.
In case of modification, the effective date will be indicated so that users are informed of the terms governing their use of the platform and services. Users are responsible for regularly reviewing these conditions. We may, without notice or liability, suspend or interrupt all or part of our platform and restrict one or more accesses in case of a major issue detected. Any violation of these conditions immediately terminates your right to use the platform and services, as well as any licenses or rights granted to you.
Introduction
Winstory is a decentralized NeoMarketing platform operating on the blockchain, showcasing content created by Generative AI Video, allowing:
- In the Traditional Way (TW): Companies to launch interactive campaigns, moderated by Moderators staking the \$WINC token. Contributors participate in and complete these campaigns, and \$WINC stakers to moderate and rate contributions.
Companies gain economic profits and notoriety upon paid completions by providing incentive rewards.
Moderators/Stakers gain economic profits if their decision (valid/refuse) is relevant, i.e., selected by the majority of moderators as a unanimously approved decision. They then share a major portion of the transactions relative to the portion proper to the Winstory company. Hence the notion of decentralization of moderation. Communities gain exclusive rewards from the Initial Company and a sense of belonging. Rewards are automatically distributed by Winstory if their paid complementary contribution is validated by decentralized moderators, thus corresponding to the moderation criteria and the initial Guideline set by the Company. Moderators score a unique rating out of 100 for each contribution to facilitate ranking and differentiate positions, avoiding favoritism. The top 3 contributions, in addition to receiving the Standard reward like all validated contributions, also receive Premium rewards.
- In the New Way (NW): An individual to initiate a story, moderated by Stakers, and upon validation, individual contributors to participate in the initial imagination. Moderators will validate/refuse content by scoring the best contributions out of 100 to differentiate the \$WINC token prize pool for the top 3 contributions (top 3 average scores).
A "Standard Reward" is defined as any gratification automatically attributed to a contributor after validation of their complementary contribution by the collective decision of staker moderators. These rewards are accessible to all contributors whose contributions meet the quality criteria and requirements of the campaign defined by the Initial Company and comply with the moderation criteria.
A "Premium Reward" is defined as any gratification attributed to the three best complementary contributions, evaluated based on the overall scores assigned by staker moderators. Premium Rewards aim to reward excellence and the impact of individual contributions to the campaign.
Standard rewards are attributed to each validated complementary contribution by the collective decision of staker moderators.
These rewards are automatically distributed by the Winstory smart contract on the blockchain to the address of the validated completion, based on the parameters defined by the Initial Company.
Premium rewards are reserved for the three best complementary contributions, based on the average scores assigned by staker moderators.
These rewards are awarded after the end of the campaign, within a maximum of 7 days, and are also automatically distributed by the smart contract to the 3 addresses of the best-rated completions on average.
These Terms and Conditions govern all interactions between stakeholders (Initial Companies, Completing Communities, Staker Moderators) and ensure the sustainability of the platform while respecting the specificities of the blockchain ecosystem.
The 4 Categories of Rewards
1. Digital Tokens:
- Description: Digital tokens (tokens) based on the blockchain, representing monetary or utility value in the Web 3 ecosystem.
- Exemples: Airdrop, giveaway, loyalty points, governance tokens, in-app credits etc..
2. Digital Items:
- Description: Exclusive digital objects in the form of NFTs (non-fungible tokens), possessing proven rarity and uniqueness on the blockchain.
- Exemples: Legendary armor in a video game, collectible artworks, digital badges, branded virtual merchandise etc..
3. Digital Exclusive Access:
- Description: Exclusive access to digital content or services reserved for reward holders, verified by NFT or wallet.
- Exemples: Invitations to virtual events, early access to premium features or content, subscription to premium content, access to private communities, beta testing of new products etc..
4. Physical Exclusive Access:
- Description: Rewards providing access to physical events or experiences, often associated with an NFT or digital code to verify eligibility.
- Exemples: Participation in VIP events, seminars, or exclusive experience organized by the Initial Company etc..
For information and to conclude the introduction, here is the succinct process of the Traditional Way, from the Initial Company to the Community of individual completers (excluding the Concept phase):
1) Campaign Initiation (text + video) + financial parameterization of the campaign (perceived value by the community < unit value of the reward on Winstory > cost value) + expected profit. To determine the total number of rewards to be attributed and distributed.
2) MINT (payment) on Winstory + mandatory 24-hour pending phase to send all Standard and Premium rewards to Winstory via the public blockchain.
3) Moderation of the Initiation by Stakers:
Once the pending phase is over, staker moderators review the campaign to ensure it meets the established criteria.
Validation is based on several factors: content compliance (originality, quality, absence of plagiarism), economic parameter coherence, and verification of reward transfers on the blockchain.
In case of non-compliance, the campaign is rejected, resulting in a loss for the Initial Company of the initial MINT amount.
4) Opening Completion to the Community:
Once validated, the campaign becomes accessible to the community of completers, who can contribute by submitting complementary content according to the narrative lines defined by the Initial Company.
Each complementary contribution is subject to a MINT payment by the contributor, based on the unit value of the completion defined in advance.
5) Moderation of Completions by Stakers:
- Staker moderators review and validate each contribution submitted by the community based on quality criteria and adequacy with the initial story.
- Validated contributions are rated and ranked, while those deemed insufficient, inappropriate, or contrary to the platform's values are rejected.
6) Automatic Distribution of Rewards:
Contributors whose contributions are validated automatically receive their Standard Rewards via the Winstory smart contract.
Upon campaign closure (after 7 days or when the completion quota is reached), the three best contributions, determined by their average score assigned by moderators, receive their Premium Rewards.
7) Finalization and Closure of the Campaign:
Once the completion period is over, the campaign is archived on the blockchain, ensuring transparency and traceability of actions performed.
The Initial Company receives its net profit, defined by contributor payments, the imputed ratio of the unit contribution (50%). Its initiation, as well as the 3 best completions, are available for everyone to see and will later benefit from copyrights (streaming, metaverse, related stories).
Concept (PoC/MVP)
During the PoC/MVP phase, called Concept, Initial Companies + their 10 contributors (scored and rated by the Initial Company itself) are eligible for the Airdrop of \$WINC tokens. Mainly the Initial Company and completion No. 1/10.
During this Concept phase, Initial Companies are free to:
- Distribute a reward to all 10 contributors (similar to Standard Rewards from V. 1 and later).
- Distribute a reward to the creator of completion No. 1/10 scored and rated by the Company (similar to Premium Rewards from V. 1 and later).
- Not distribute any special reward, neither Standard nor Premium, limiting eligibility to $WINC tokens for the 10 contributors.
The Concept phase is entirely free for Initial Companies and the 10 contributors.
The Concept phase is time-limited and audience-limited for Companies and contributors, at the discretion of the Companies and Winstory. The Concept phase is available on the website.
1. Initial Companies
An "Initial Company" or "Initiator" is defined as any entity or legal person creating a campaign on the Winstory platform after validating the payment of the initial MINT. Initial Companies are responsible for transmitting rewards, compliance of submitted content, and adherence to these terms and conditions to be validated by the collective decision of Moderators. Initial Companies actively participate in creating interactive campaigns in collaboration with Completing Communities and Staker Moderators.
- Access to the platform is subject to acceptance of these Terms and Conditions, ensuring compliant use according to defined rules.
- Initial Companies must create an account on the platform and provide necessary information, including a wallet address compatible with the blockchain network supported by Winstory (Polygon).
- Companies must provide all standard and premium rewards to Winstory before automated redistribution to validated Contributors.
PoC/MVP Phase: The Initial Company and its 10 contributors from the community associated with the campaign are eligible for the Airdrop of \$WINC tokens. Initial Companies are free to establish or not a specific reward for contribution No. 1/10. The Company scores complementary contributions to differentiate them. Contribution No. 1/10 will receive a larger share of \$WINC tokens than contributions No. 2/10 to 10/10.
V. 1 and later versions: With the technological infrastructure, rewards intended for community members initiated by Companies must be transferred to the blockchain to the Winstory smart contract upon campaign launch. The initial MINT phase is followed by a 24-hour pending period, during which the Company must send all Standard and Premium rewards to Winstory. Without sending within 24 hours, moderation will refuse access to Completions, resulting in the Company's financial loss of the initial MINT amount and a tarnished image.
- The transmission includes all rewards planned in the campaign, according to defined categories (digital and/or physical).
- If rewards are not correctly transferred, the campaign is automatically refused.
- Any fraud or attempt to circumvent will result in a platform ban and legal action.
Initial Companies, to ensure campaign validation, must guarantee that the submitted content is:
- Original, free of plagiarism, and respects intellectual property rights.
- Compliant with laws in applicable jurisdictions.
- Aligned with Winstory community quality standards and values.
- A visual creation enhanced by Generative AI and/or VFX.
- Displays magical sophistication in the beauty and creative research of the content.
The Initial Company (outside the PoC/MVP phase) accepts that:
- Its initial campaign (text + video) is accompanied by sending all rewards to Winstory.
- Any initiated campaign is irrevocable once validated. A campaign is promoted, featured on our platform, and available for completion for 168 hours from moderator validation (7 days, one week).
- Rewards transmitted to Winstory for distribution are final and cannot be claimed once transferred to the blockchain.
- In case of disputes related to the campaign, legal responsibility falls on the Initial Company.
Initial content will later serve as a source of revenue for their creators upon implementation of Streaming and Metaverse functionalities.
For now, visual content submitted on the Winstory platform by Initial Companies may be reused by Winstory for communication purposes on its official social media channels (e.g., X, Instagram, LinkedIn, YouTube, Discord, etc.).
This reuse is limited to organic use only, i.e., without including this content in paid or sponsored advertising campaigns.
Creators' moral rights are respected, and their initiation will be credited when possible.
By submitting content on the platform, the user grants Winstory a non-exclusive, worldwide, and free license for this specific use.
A campaign may be suspended or removed by \$WINC staking moderators of Winstory if it does not meet the following criteria:
- Original and compliant content with established standards.
- Rewards correctly deposited on the blockchain.
- Absence of third-party rights violations or applicable laws.
Winstory reserves the right to remove a campaign without refund if serious violations are found by decentralized moderators.
Initial Companies must precisely define the parameters of their rewards when creating their campaign, including:
- The unit value of standard rewards.
- The nature of rewards (tokens, NFTs, exclusive access, or physical events).
- Premium rewards, if applicable, must be clearly differentiated and valued.
Reward attribution must be entirely transferred to the blockchain before campaign launch. Otherwise, the campaign will be rejected.
If a Company plans standard and/or premium rewards as exclusive access to a physical event, the company receives its profit after the event to avoid scam risks and deception regarding a ghost event. In case of proven fraud regarding the physical event, Winstory will take legal action against the Company for moral prejudice with the support of victims who will have been refunded by freezing profits intended for the Company.
Applicable sanctions in case of violation of these Terms and Conditions, including fraud, non-compliance with quality criteria, or non-transmission of rewards, are decided exclusively by staker moderators, in accordance with the platform's decentralization principles, with prior specific mention by Winstory on the campaign link in case of suspected issues.
These sanctions may include, but are not limited to:
- Temporary or permanent ban from the platform.
- Immediate rejection of the ongoing campaign.
In case of disagreement with a refusal decision by moderators, Initial Companies have a maximum of 24 hours to submit a formal appeal.
This request is reviewed by a secondary pool of staker moderators and ambassadors. The decision rendered by this pool is sovereign and irrevocable.
2. Stakers/Moderators
A "Staker" or "Moderator" is defined as any wallet participating in the staking of WINC, allowing contribution to the moderation of campaign content (Initial and/or Complementary). Stakers play a key role in the decentralized process of verifying and ensuring the quality of contributions by voting and scoring content submitted by Completing Communities out of 100. They are rewarded proportionally to their participation in staking and majority decisions they support relative to the staking pool. Conversely, they are penalized by a loss of tokens proportional to the minority decision they support relative to the staking pool.
Stakers intervene in the moderation of initial content at least 24 hours after the Initial Company's MINT to allow the Company time to send all Standard and Premium rewards during the pending phase.
No minimum amount condition is required for staking. The amount influences the quantity of gains or losses generated at the end of the campaign.
Stakers participate in the moderation of contributions and receive rewards proportional to their participation.
The final decision on content moderation (whether initial or complementary) requires 3 conditions to be met:
- A minimum of 22 Stakers have either chosen "Valid" or "Refuse."
- Staking Pool > Value of the MINT of the content (initial/complementary).
- Majority of votes / Minority of votes ≥ 2.
The decision is not final until these conditions are met. The moderation process is ongoing otherwise.
Stakers aim to moderate content by selecting coherently, impartially, and proactively.
Note: For campaign initiation, Stakers must also ensure that the initial address has sent all Standard and Premium rewards to Winstory's address on the blockchain, reinforcing campaign validation beyond visual content quality.
$WINC stakers (222,000,000 tokens available on a minimum 5-year vesting) have an economic gain interest and transaction sharing.
In TW, Stakers share 51% of the initial transaction. In case of validation of the initial campaign, 40% of the MINT of the unit completion goes to Stakers.
In NW, Stakers share 35% of the initial transaction. In case of validation of the initial campaign, 40% of the MINT of the unit completion goes to Stakers.
Regular audits are conducted to ensure the security of smart contracts.
Smart contracts are open-source to allow community verification.
Staker decisions during moderation votes are final and cannot be contested.
Winstory reserves the right to temporarily suspend staking in case of detected vulnerabilities in the system.
Calculation of Staker Gains/Losses
Gain:
If a Staker moderates content correctly (i.e., their personal decision matches the collective moderation's final choice), they automatically receive their profit at campaign closure (7 days).
Calculation of Gains:
((WINC Staked by STAKER / WINC STAKE POOL) * 35%) / (WINC Staked by STAKER / WINC MAJORITY STAKED) * (WINC MINORITY STAKED / WINC STAKE POOL * WINC MINORITY STAKED)
Loss:
A Staker incurs a loss when they moderate content incorrectly, i.e., their personal decision does not match the majority decision of collective moderation. In case of loss, a portion of the Staker's staked WINC is automatically burned (removed from the total supply of WINC), reducing their staking balance.
This "burn" mechanism aims to discourage inconsiderate or contrary decisions to the platform's quality standards, reinforcing the integrity of the collective moderation process.
Description of Loss:
- The burned proportion is calculated based on the misalignment between the Staker's individual vote and the majority decision.
- This penalty is automatically applied at campaign closure, ensuring transparent and irreversible execution via the smart contract.
Calculation of Losses:

Burned WINC does not return to the global pool but is permanently removed from circulation, enhancing the rarity and potential value of remaining tokens.
Stakers aligned with the majority decision benefit from proportional gains, while those in disagreement face a proportional decrease in their WINC holdings.
We ensure that Stakers carefully analyze content, the integrity of Initial Companies, the quality of Community completions before voting.
This reinforces the overall quality of moderation and the coherence of collective decisions.
Refusal Criteria for Moderators
1. Initial Content
Staker moderators can refuse an initial campaign if:
- The Company's rewards are not correctly transferred to the blockchain before moderation by Stakers.
- The initial content does not meet the following criteria:
- Originality and uniqueness, failure to highlight the brand.
- Respect for intellectual property rights.
- Compliance with applicable laws (illegal content, plagiarism, or third-party rights violations).
- Hate speech, violence, or discriminatory content.
- Explicitly illegal elements (deepfakes, plagiarism, etc.).
2. Complementary Contributions
Moderators can refuse a complementary contribution if it presents:
- Insufficient quality or content inconsistent with the initial story.
- Hate speech, violence, or discriminatory content.
- Explicitly illegal elements (deepfakes, plagiarism, etc.).
- Abusive or inappropriate use of the platform, such as automated submission or repetition of identical content.
Active Stakers & Passive Stakers
In the Winstory ecosystem, Stakers play a central role in moderating campaign content. However, not all Stakers actively participate in moderation decisions due to availability or speed in executing moderation. To effectively structure reward distribution and ensure balanced incentives, we distinguish two categories of Stakers:
- Active Stakers:
A Staker is considered Active when they directly participate in moderation by voting on a campaign (Initial or Complementary). Their engagement is reflected by:
- A "Valid" or "Refuse" vote on content, based on moderation criteria and relevance (e.g., verification of reward transmission on the blockchain).
- Participation in collective moderation (minimum 22 votes required to finalize the validity or refusal decision of content).
- Contribution to the staking pool via the quantity of staked \$WINC tokens, determining proportional gain or loss relative to the staked value.
- A quality rating uniquely for complementary contributions by assigning a score out of 100, differentiating Premium Rewards.
- Passive Stakers:
A Staker is Passive when they stake \$WINC tokens but do not actively participate in moderating ongoing content. They still contribute to network stability by locking their tokens in the staking pool. They should be indirectly rewarded for this.
2. Reward Distribution between Active and Passive Stakers
The reward pool reserved for Stakers is structured to encourage active engagement while maintaining incentives for Passive Stakers. In TW, the remuneration, as a reminder, comes from the majority value of the Initial Company's MINT (51% to Active and Passive Stakers, vs. 49% for Winstory), as well as a significant value of the MINT of individual Community member contributions (40% to Active and Passive Stakers, vs. 50% for the Initial Company, vs. 10% for Winstory).
- 90% of Staker remuneration is allocated to Active Stakers of a specific campaign.
- 10% of Staker remuneration is redistributed to Passive Stakers proportionally to their total staking amount.
Calculation of Reward Distribution
Active Staker Rewards
- Active Stakers share 90% of the reward pool based on:
- Their quantity of staked \$WINC.
- Their participation in votes and scoring.
- Their alignment with the majority decision (aligned votes are better rewarded).
Active Staker Reward = (WINC Staked by Staker / WINC STAKE POOL Active) * 90% * Total MINT to Stakers
Passive Staker Rewards
- Passive Stakers share 10% of the reward pool proportionally to their quantity of staked WINC:
Passive Staker Reward = (WINC Staked by Staker / WINC STAKE POOL Global) * 10% * Total MINT to Stakers
3. Incentive for Active Moderation and System Balance
- Priority to Active Engagement:
- A Staker who regularly votes on ongoing campaigns increases their chances of receiving a larger share of rewards.
- If a Staker remains inactive over several campaign cycles, their \$WINC yield will be lower than that of an active Staker with an equal quantity of staked tokens.
- Avoiding process blockage in case of low participation:
- If fewer than 22 Active Stakers are present for a given campaign, moderation remains accessible to Passive Stakers, who can exceptionally vote to ensure a final decision.
- In this case, a temporary incentive bonus of +20% on rewards will be granted to encourage active participation.
Security and Audit of Staking Mechanisms
- All staking and reward distribution mechanisms are automated via audited smart contracts.
- The distribution of rewards and the quantities of tokens lost via burn are transparent and traceable on the blockchain to ensure system integrity.
- In case of severe vulnerabilities detected, such as a smart contract flaw allowing exploitation, usurpation, or falsification of token gains and losses, Winstory reserves the right to temporarily suspend staking to prevent potential exploits.
3. Completing Communities
A "Contributor," "Completer," or "Community Member" is defined as any wallet completing the story initiation and proceeding with the paid MINT of complementary contribution. These contributors actively participate in creating and enriching campaigns by submitting original content, which is then validated or rejected by Stakers based on quality and compliance.
- Contributors certify being the unique authors of submitted content.
- Any plagiarized content is automatically rejected, and the contributor may lose their rights to any reward.
The top 3 completions, eligible for Premium Rewards (TW) or the \$WINC Prize Pool (NW), will later serve as a source of revenue for their creators upon implementation of Streaming and Metaverse functionalities.
For now, visual content submitted on the Winstory platform by Completing Communities may be reused by Winstory for communication purposes on its official social media channels (e.g., X, Instagram, LinkedIn, YouTube, Discord, etc.).
This reuse is limited to organic use only, i.e., without including this content in paid or sponsored advertising campaigns.
Creators' moral rights are respected, and their contribution will be credited when possible.
By submitting content on the platform, the user grants Winstory a non-exclusive, worldwide, and free license for this specific use.
Contributor wallet addresses are truncated in Winstory's public interfaces to ensure a minimum level of confidentiality while respecting the transparency inherent to the blockchain.
An integrated reporting system on the platform allows reporting abuse and fraudulent behavior.
Collaborative tools, such as note-sharing, will gradually be implemented to assist moderators in their work.
Rejected contributions remain the exclusive property of contributors and cannot be reused by Winstory without explicit authorization.
Contributors have the option to appeal to a pool of platform moderators and ambassadors (including Winstory). If the appeal is successful, they receive their reward, and the initial stakers who voted against the contribution face a penalty.
Contributors cannot modify and resubmit a rejected contribution at a reduced cost: the cost remains the same for all.
Once validated by collective decision, a complementary contribution automatically triggers the distribution of standard rewards to the user's wallet.
Premium contributors (the three best contributions) will receive their rewards within 7 days after the end of the campaign.
Contributors must ensure that their wallet is compatible with the blockchain standards used by Winstory.
4. General
Winstory declines all responsibility for financial losses related to the use of the platform. Users acknowledge the risks inherent in the blockchain ecosystem.
Visual content submitted by Initial Companies or Completing Communities may be reused by Winstory exclusively for organic (non-sponsored) purposes on its communication channels for a maximum duration of 5 years from submission.
Creators' moral rights are protected: the creator is credited for each reuse when technically possible. Economic benefits generated by the visual creation may also benefit creators' wallets through integrated revenue-sharing mechanisms.
Once submitted, content cannot be revoked from its usage license.
Disputes are managed via a decentralized and externalized platform, ensuring impartiality and transparency.
Winstory reserves the right to suspend or terminate an account in case of serious violation of the Terms and Conditions, including, but not limited to, fraud, submission of illegal content, vote manipulation.
A recourse mechanism allows users to contest a suspension by providing evidence within 30 days.
Account termination does not affect already validated contributions but prevents any future access to the platform.
Winstory is committed to compensating for part of the carbon footprint generated by platform activities through environmental initiatives. These initiatives are undertaken at Winstory's sole discretion.
The platform prioritizes the use of low-energy-consumption blockchain networks, such as EVM PoS infra.
Winstory implements regular audits of its smart contracts by recognized third-party companies to ensure their reliability.
A bug bounty program is established to encourage developers to report any security vulnerabilities.
User funds remain under their exclusive control (non-custodial), enhancing the security and transparency of transactions.
Winstory declines all responsibility for loss of funds or data caused by blockchain network failures or events independent of the platform, such as cyber attacks or network interruptions.
In case of loss directly attributable to a technical or operational error by the platform, Winstory may consider limited compensation based on the value of the affected transaction and subject to an internal audit.
General Limitation of Liability
Winstory acts solely as a technical platform facilitating interactions between stakeholders (Initial Companies, Moderators, and Completing Communities) and cannot be held responsible for decisions made collectively via staking and moderation mechanisms.
By using the platform, users accept the risks inherent in decentralized ecosystems, including, but not limited to:
- Fluctuations in token value (WINC).
- Gas fees on the blockchain.
- Errors or delays related to third-party blockchain networks.
Winstory does not guarantee the complete absence of errors or flaws in smart contracts. However, the platform is committed to resolving identified technical issues through audits and corrections in full transparency.
2. Reward-Related Disputes
Initial Companies:
- Winstory is not responsible for the non-transmission of rewards by Initial Companies if they have not been transferred to the blockchain before campaign launch.
- Disputes between contributors and Initial Companies regarding the nature or value of rewards must be resolved directly between the parties.
Completing Communities:
- In case of a claim related to reward distribution (standard or premium), contributors can submit a review request via a dedicated form on the platform. Winstory's final decision is sovereign and irrevocable.
3. Moderation-Related Disputes
Content Refusal (Campaign or Contribution):
- Winstory cannot be held responsible for content refusal by staker moderators. These decisions are made collectively and validated by transparent decentralized voting mechanisms.
- Companies or contributors can appeal these decisions via a secondary pool of moderators and ambassadors, whose results are final.
Token Burn by Moderators:
- In case of token burn due to incorrect voting (individual vote contrary to the majority), the mechanism is automated by smart contracts and does not involve direct intervention by Winstory. Users accept these rules by participating in staking or contributing.
- Disputes related to a decision deemed "unfair" by a moderator are resolved exclusively by appeal via the secondary pool provided for this purpose.
4. Exploitation Rights Disputes
Winstory acts as an intermediary in managing the exploitation rights of content submitted by contributors and companies.
- Creators agree to grant Winstory a limited exploitation license (e.g., 5 years for organic use) upon submission of their content.
- Disputes related to content use by Initial Companies must be resolved directly between the contributors and the concerned companies.
Winstory cannot be held responsible for claims regarding content submitted by third parties (plagiarism, copyright, or inappropriate content). Affected parties can submit a claim via the tools provided on the platform.
5. Jurisdiction and Dispute Resolution
Any dispute between Winstory and users is subject to the exclusive jurisdiction of the competent courts in France, unless otherwise indicated due to regulatory changes. In case of disagreement, users agree to prioritize an amicable resolution by submitting a claim via Winstory's support service. If no amicable solution is found, the parties may resort to independent arbitration, with costs shared between the parties.
Users agree that Winstory cannot be held responsible for indirect damages, including loss of profits, data, or opportunities.
6. Acceptance of Risks by Users
By using the platform, users acknowledge and accept that decisions made by Winstory's decentralized mechanisms are final and irrevocable.
Users waive any recourse against Winstory in case of financial losses, moderation decisions they deem unfair, or disputes with other platform stakeholders.
5. Blockchain Data
Winstory undertakes not to use the personal data of users, whether they are client Companies, Moderators/Stakers, or Individuals from client Communities, for commercial purposes.
Winstory promotes best practices in security and transparency in the use of blockchain and associated data.
Users are responsible for securing their wallets and private keys. Winstory will never individually contact a user first. Each user must ensure the security of their wallet. Winstory cannot be held responsible for the usurpation of a user's wallet.
In case of an identified vulnerability, compensation may be considered after verification by internal and external experts.
No KYC is required to use Winstory. Transactions remain pseudonymous and traceable only via the blockchain.
Data visible on the blockchain (wallet addresses, transactions) are not considered personal data under applicable laws (e.g., GDPR).
Regular audits of security protocols are conducted to protect users' sensitive information, including that associated with pseudonymous wallets.
Fees related to platform use (minting, staking prices) are clearly displayed before each transaction.
Minting fees include a detailed breakdown between network costs and revenue generated for Winstory.
Staking fees are fixed or periodically adjusted based on market conditions, subject to approval by the DAO. They remain independent of Winstory's will, as they are linked to external platforms.
Performance tracking dashboards for campaigns, including detailed data on contributions, distributed rewards, and overall impact, are exclusively accessible to Initial Companies subscribed to a minimum monthly plan of 500 € (MRR).
These advanced features are not available in a free version, and the subscription must be active to guarantee continuous access to dashboards.
